Tyde Collective — Terms of Service

(Effective December 2025)

Welcome to Tyde Collective. These Terms of Service outline the conditions for participating in our sessions, purchasing our products, and engaging with our community offerings such as Rise Club, retreats, digital guides, and events.
By accessing or purchasing from this website, you agree to the following terms.

1. General Overview

Tyde Collective (“we”, “us”, “our”) provides wellness events, digital products, yoga sessions, and community experiences. All offerings are designed with safety, inclusivity, and respect at the core.
Participants and customers (“you”) agree to engage responsibly and in accordance with the information provided.

2. Booking & Payments

  • All bookings are final at the time of purchase unless otherwise stated.

  • Payments are processed through our secure online checkout.

  • Prices are in NZD and may include GST when applicable.

  • If you cannot attend an event, you may transfer your ticket to another person by emailing us with their details.

3. Cancellations, Rescheduling & Weather

Rise Club / Outdoor Events

Because Rise Club sessions are outdoors:

  • Sessions may be rescheduled or modified due to weather, tides, or safety concerns.

  • If a session is cancelled by us and cannot be rescheduled, you will receive a refund.

  • If you cannot attend a rescheduled session, you may request a credit or transfer.

Retreats & Multi-Day Events

Cancellation policies will be clearly stated on the event page.
Unless otherwise stated, deposits are non-refundable.

4. Participation Waiver & Safety Agreement

(Applies to all Rise Club sessions, yoga classes, ocean swims, workshops, and physical activities hosted by Tyde Collective.)

By booking any Tyde Collective event, you acknowledge and agree to the following:

4.1 Personal Responsibility

I understand that participating in yoga, mindfulness practices, movement sessions, and open-water swimming involves physical exertion and natural environmental risks. I participate voluntarily and accept full responsibility for my well-being.

4.2 Health & Fitness

I confirm that:

  • I am physically able to participate in the activities offered.

  • I will disclose any injuries, health conditions, or pregnancy to the facilitator prior to the session starting.

  • I will listen to my body, modify movements as needed, and stop if I experience discomfort.

4.3 Ocean Safety

I acknowledge that:

  • Open-water swimming involves inherent risk, including waves, tides, cold water, weather, and marine conditions.

  • I am responsible for entering the water only to a level I feel confident and safe with.

  • The facilitator is not a lifeguard and cannot offer individual water supervision.

  • Conditions may require the swim portion to be cancelled, modified, or replaced with an alternative activity.

4.4 Environmental Conditions

I understand that Rise Club takes place outdoors and that:

  • Weather, tides, or environmental changes may impact the session.

  • The facilitator will make safety-first decisions at their discretion.

4.5 Liability Release

To the fullest extent permitted by New Zealand law, I release Tyde Collective, Hayley Rewi, collaborators, partners (e.g., Onae), and associated contractors from liability for:

  • Injuries or accidents that occur during participation

  • Health impacts related to exercise, cold-water exposure, or ocean conditions

  • Loss, theft, or damage to personal belongings

  • Any incidental risks associated with participating in outdoor or movement-based activities

This does not limit liability where negligence cannot legally be excluded.

4.6 Photography & Content

I understand that photos or videos may be taken for storytelling and marketing.
If I prefer not to be included, I will notify the facilitator before the session begins.

5. Health & Medical Responsibility

  • You are responsible for ensuring you are medically and physically able to participate in any offered activity.

  • If you feel unwell, dizzy, uncomfortable, or unsafe at any time, you agree to stop or modify your participation.

  • We reserve the right to ask a participant to sit out if safety is compromised.

6. Behaviour, Respect & Community Standards

Tyde Collective is a community grounded in respect, kindness, and inclusion.
We reserve the right to remove any participant from an event or digital community if behaviour is unsafe, disruptive, disrespectful, or discriminatory.
No refund will be issued in cases of misconduct.

7. Digital Products

For e-books, guides, templates, or downloads:

  • All digital sales are final and non-refundable.

  • Sharing, reselling, or distributing Tyde digital files is not permitted.

  • You may store and use digital content for personal use only.

8. Photography & Content Use

At Rise Club, retreats, and events:

  • Photos and videos may be taken for community storytelling and marketing.

  • If you prefer not to be photographed, you must let us know before the session begins.

  • Creators collaborating with us (photographers, videographers) retain standard creative rights unless otherwise stated.

9. Intellectual Property

All brand assets, content, written material, photography, and digital products under Tyde Collective are owned by us and cannot be copied, redistributed, or repurposed without written consent.

10. Liability

To the fullest extent permitted by NZ law, Tyde Collective and Hayley Rewi are not liable for:

  • Injuries, accidents, loss, or damage arising from participation in events, yoga sessions, ocean swims, or activities

  • Loss of personal belongings

  • Acts of nature or environmental conditions

  • Any misuse of digital products

This does not exclude liability for negligence where it cannot be lawfully excluded.

11. Changes to Terms

We may update these Terms of Service from time to time.
By continuing to use the website or attend events, you agree to any future updates.
The most current version will always be available on this page.
